By commissioning me, the Artist, you the Client agree to the following;
The Terms & Conditions outlined in this document.
You are of legal age and have financial capability to purchase digital goods and services.
You will not file for disputes or chargebacks and agree to contact me first for corrections, adjustments, or refunds for the commissioned work.

◆ ◆ PRIVACY POLICY ◆ ◆
Please note that the client's or artist's legal name, country of origin, address, and other personal information may come up and be known to either party during the commission process, specifically during payment if the clients PayPal account is not a business account.
Both the client and artist solemnly swear not to share any of each others personal information and reserve to use it only during cases of dispute or providing proof of work to relevant government bodies or banks.

◆ ◆ GENERAL TERMS ◆ ◆
General terms apply to all art/works created by the Artist.
You cannot claim that you created any of my work under any circumstances.
Please credit/link back to the Artist/'s social media if you share my works.
You may not Repost my works. Reposting is not equal to Sharing.
I reserve the right to use works & their processes/drafts that lead up to them for social media posting and portfolio-building.
I reserve the right to give and refuse service to offers made for my work.
I reserve the right to cancel any offers made for my services. This will follow with a refund as needed.
All my artworks (personal, commissioned, fanart, drafts/works in process, etc.) will be signed and/or watermarked. You may not remove or cover them in any form.
You may not use my works in personal uses (ie. profile pictures, banners, character faceclaims, etc) or commercial purposes. Commissioned pieces fall under different terms.
You may not modify, adapt, build-upon, remix, make derivatives, or redistribute my works for personal or commercial use.
Fanart is ok and encouraged as long as you respect rules and preferences applied to the work and/or character by the Artist.
I do not support NFTs, crypto, or similar trends. I will not entertain requests of this nature and if any of my work is spotted in sites supporting these, it is not me.
I do not accept crypto, NFT trades, or similar as payment.
I DO NOT give permission to have or use ANY of my works and art to feed, scrape, train, redraw, finish, remix, create derivatives, have elements removed, covered, cropped, or otherwise ANY type of use or modification, be it personal or commercial, to AI. I will not work or entertain requests with AI in general.

◆ ◆ Commission Process ◆ ◆
I may be contacted to reserve commission slots via Discord, VGen, or email. Other avenues and social media for contact are available in my homepage.
Accepted clients will be notified on their chosen platform of initial contact.
Commission slots are finalized after first installment or final payment and work can begin.
Non-VGen Clients using Paypal as their payment method will need to provide an email for invoicing.
Drafts and works-in-progress shots will be provided during each stage of the commission. Progress is also viewable in the provided Trello Board.
The Final product will generally be a 350dpi PNG or JPG image. Specific details/dimensions will vary with commission type.
Commission Installments need to be paid in full before final image is sent out.
Commissioned pieces, once received, can be used by client for their general needs (faceclaims, profile bits, etc.). This does not include commercial/reselling of the work unless specifically discussed.
Commissioned pieces are generally considered non-commercial. If they are to be created for commercial use, contact the Artist to sort out relevant details and fees.
────── ◆ DEADLINES & EXTENTIONS ◆ ──────Commissions will generally take a month to finish depending on complexity and content.
Artist must be notified if a commission has a specific deadline.
The Artist has rest days between work, so not much may happen on weekends. Communication lines will still be open in case of notifications or changes to apply.
Delays will be notified to the client as they occur.
Should a work be unable to meet a deadline, the Artist will contact the Client and notify them of the situation and ask for an extension.
If the extension is denied, then a refund will be processed.
────── ◆ REVISIONS & FEEDBACK ◆ ──────The Artist will provide updates via WiPs and screenshots in different phases to the Client to view progress of the commissioned work.
WiPs will be sent through DMs and updated on the Commission Trello Board.
WiPs will be watermarked.
Illustrations in a standard process will always follow this pipeline: Rough Sketch, Clean LineArt, Flat Colors, and Full Colors.
Each WiP phase is an opportunity to get feedback on what to adjust or try out before moving on to the next phase of the work.
Revisions are generally free while the work is in-progress, though once the work has already reached near-completion or is completed the Artist will start to charge for further edits depending on significance to the overall piece.
Major revisions will always have a fee and include the addition of extra elements (characters, lighting, background, etc.) and drastic changes to the colors, form, posing, and expressions to the subject/work.
────── ◆ FEES ◆ ──────
The client will be charged additional fees when:Too many revisions have been made.
The commission has more elements in it than what is included in the purchase (see Revisions #6).
The commission is a rush order (30% of commission total).
The commission is an illustration to be used for commercial purposes (50% of commission total).
────── ◆ REFUND POLICY ◆ ──────
Before the final product is delivered, either party can request a refund for the commissioned work. Refunds are no longer available after the final file is delivered.Full refunds are given when:
♦ The Client has requested a refund before any substantial work has started or if the project is still in the sketch-phase.
• Please note however that Sketch/Lineart commissions will not have any refunds.
♦ The project has been terminated by the Artist
♦ The Artist cannot fulfill a commissions deadline and the Client has rejected the extension
Partial refunds are given when:
♦ The sketch is done for flat/full/reference commissions (70% refund)
♦ Base colors are done or a WiP (50% refund)
♦ Partial rendering is done or a WiP (30% refund)
No refunds will be given when:
♦ The work is in final rendering and finished.
♦ When the finished commission piece is sent out.
♦ The commission is a Sketch commission.
♦ The Client is dishonest about their satisfaction with the work and withholding feedback and disapproval throughout the commission process, only to request the refund when work is either near-completion or progress is irreversible.
♦ There has been no communication between Client and Artist despite reaching out for updates and feedback for a specified amount of time. (ie. Ghosting)

◆ ◆ INTELLECTUAL PROPERTY & COMMERCIAL USAGE ◆ ◆
────── ◆ THE CLIENT ◆ ──────
The client must not claim as their own and must give credit.
The client must not remove signatures and watermarks off the work.
Commercial-made works must have credit attached. Link back to any of the social media sites available to the Artist.
The client is free to use commissioned works for personal use. This includes profile pictures, backgrounds, aesthetic boards, etc.
The client IS NOT use any of my works for NFTs or crypto-related activities or purposes.
The client IS NOT to use my works in feeding and training AI models. They ARE NOT to use them for any AI related activities whatsoever. See General Rules.
────── ◆ THE ARTIST ◆ ──────If the Client files a chargeback, then the Artist has the right to modify the work and resale to cover costs.
The Artist has the right to use their works and drafts for their portfolio and promotion of their works.
The artist is allowed to use assets available to all artists and models.
The artist is NOT allowed to resell finished & approved commissions.
